Appearing handcuffed in Courtroom 103 on Thursday March 8,2018 before the Honourable Justice Frank Valente is 35 year old LEON ADAM LINKLATER. The Crown Attorney is Rob Kozak and Defence lawyer is Tyler Woods.
Linklater is about 5’8” tall and has a stocky build. He’s pleading guilty to robbery and aggravated assault. Admitted facts before the court are that on November 24,2017, Linklater went to LCBO on Dawson Road and grabbed a 1.75 litre bottle of vodka valued at 50$ and left store with it. The Loss Prevention Officer approached him about this theft. Linklater was brandishing a knife but gave vodka back. He then walked across parking lot to Walmart area where he and another male individual began assaulting a male victim. Linklater used the same knife used at LCBO to slash the victim’s face and back several times. Victim had several large gashes cut into him. Linklater is arrested by Thunder Bay Police and held in custody ever since.
Gladue factors are that he is originally from North Spirit Lake Indian Reserve. Both parents went to residential school but they were good parents. His father had a stable job and provided for the family. Leon started hanging out with the wrong friends as a teenager. Linklater has a very lengthy and violent record of assaults, aggravated assaults, assault with a weapon, assault causing bodily harm and choking overcoming resistance dating back to 1999 when he was a youth. His last aggravated assault got him a 20 month jail sentence.
Joint submission is 2 year penitentiary term plus 18 months probation. Linklater has nothing to say to the court. Judge Valente tells Linklater “There is absolutely no justification for this attack, this is appalling. A penitentiary sentence is justly deserved.” The Judge feels this sentence is on the lenient side but cedes to the joint submission.
A DNA order is issued and no contact with victim. 400$ victim surcharge is ordered plus weapons ban. Linklater is led from Courtroom by Thunder Bay Police smiling and waving to a family member. He’s going to Thunder Bay Jail but will be heading to a federal penitentiary in the very near future.
