Appearing before Her Honour Justice Elaine Burton this morning to plead guilty to failing to provide a breath sample is 25-year old DALE CIZMAR.
CIZMAR is average height and weight and is represented by local lawyer Christopher Watkins. Crown Attorney Sarah Munch reads the admitted facts into the court record.
On Saturday, December 2, 2017, at 1:45 am, police were called by staff at McDonald’s on Arthur St about a suspected drunk driver in black SUV falling asleep at the drive-thru. Police arrived and found the driver behind the wheel in a parking spot. There were numerous empty alcohol containers in the vehicle and he was wearing a Pub Crawl t-shirt with numerous signatures on it. He first told police he only had one drink. Then he said he had 2 drinks.
He then admitted to police that he was a G2 driver and would probably blow over.
He kept clenching his teeth when officers demanded a breath sample. They were unable to obtain proper readings. He was warned he would be charged with failing to provide a sample. Three attempts were made and he was charged.
Court hears that CIZMAR works with flooring, has no kids and no criminal record.
He’s fined 1000$ and a one-year driving suspension.
Justice Burton asks CIZMAR if he has anything to say. CIZMAR says he’s learned his lesson.
