(NIPIGON, ONT) – Appearing in courtroom 104 this morning by telephone is 21-year-old Mason Andrew Potan. His Worship Bruce Leaman is presiding, along with Derrick Silvestro as the Provincial Crown Attorney, and Andrew Desmoulin as duty counsel.
Potan seems attentive, responsive and aware throughout the proceeding.
Potan has has been charged with the following charges:
- Mischief causing damage under $5000 (a door)
- Assault Police
- Resist Arrest (physically struggled with police)
The Crown identifies that this is a Crown onus situaiton, and further claims that there are concerns surrounding the secondary grounds. He is willing to consent to release if there is a strong release plan set in place.
He indicates that a strong plan is unlikely today, and he intends to show cause as to why Potan should remain in custody.
Crown Attorney Silvestro requests a 516 (2) order, which would prohibit Potan from contacting or communicating with the complainant.
Duty Counsel Andrew Desmoulin admits there is no plan in place as of yet, and will need some time to craft one. David Dubinsky is Potan’s lawyer, and Desmoulin indicates that he will email him to let him know about the status of his client.
Desmoulin requests the matter be put over until Monday June 11th, 2018.
His Worship Leaman orders Potan remanded into custody on consent until Monday June 11th, 2018.
