TBAY DRUG BUST WITH TIES TO TORONTO AREA

This article contains two court appearances, one regarding Rikki Shyanne Donnelly, the second regarding Jasanthan Kandiah. Both accused are believed to be drug traffickers from Southern Ontario, and have an alleged history of violent robberies where guns have been discharged.

(THUNDER BAY, ONT) โ€“ Appearing in courtroom 104 this morning is 20-year-old Rikki Shyanne Donnelly. His Worship Bruce Leaman is presiding, along with Ron Poirier as the Federal Crown Attorney, Derrick Silvestro as the Provincial Crown Attorney, and Andrew Desmoulin as duty counsel.

Donnelly appears sluggish, tired, and annoyed.

Donnelly is charged with the following:

  • Possession for the purpose of trafficking (Cocaine)
  • Possession for the purpose of trafficking (Marijuana under 3 kilograms)
  • Fraudulent impersonation with intent to avoid arrest

The Crown states this is a Crown onus situation, but informs the court that Donnelly is wanted in Kingston, Ontario for an armed robbery in which a gun was discharged.

Furthermore, the Crown believes that southern Ontario police will be requesting she be transferred there to answer to these charges.

The Crown has REAL Concerns on all three grounds, which are primary, secondary, and tertiary. Primary grounds means the Crown believes the likelihood of the accused to show up for court is in question. Secondary grounds means the Crown believes that the likelihood of the accused to reoffend or become a public safety issue is substantial. Tertiary grounds means the Crown believes if the accused is released that the public may lose faith in the administration of Justice.

The Crown indicates their intent to hold Donnelly for 6 days, in order to give police time to organzie her transfer down south.

Duty Counsel requests that Donnelly be remanded into custody until Monday June 11th, 2018, which is ordered by His Worship.

Kandiah is visibly short, Iโ€™d estimate around 5-foot-3, has dark skin, and responds mostly with 1 word answers.

Kandiah is charged with the following:

  • Possession for the purpose of trafficking (Marijuana less than 3 kilograms)
  • Possession for the purpose of trafficking (Cocaine)

The Crown states that this is a reverse onus situation, and that Kandiah is wanted in Kingston for 4 alleged robberies, one of which a gun was discharged.

Kingston police want Kandiah held for 6 days so that they may arrange his transportation to southern Ontario to answer to the outstanding charges.

Furthermore the Crown indicates their are concerns on the primary, secondary and tertiary grounds regarding Kandiahโ€™s release.

Duty Counsel requests Kandiah be remanded into custody for a June 11th, 2018 appearance.

His Worship remands Kandiah back into custody until June 11th, 2018.
