(THUNDER BAY,ONT) – In a ruling released  this morning, CN has breached their agreement and must reopen the James Street Bridge.

The Ontario Court of Appeal has overturned last years Ontario Superiors Court of Justice ruling, which left the bridge closed.

“This is a good day,” said Mayor Keith Hobbs. “The highest court in Ontario has ruled in our favour, and we now look to CN to repair and reopen the bridge as they are obligated to do so.”

“We are very pleased with today’s decision,” said City Manager Norm Gale. “We expect that CN will now carry out any necessary repairs and reopen the bridge.”

The bridge has been closed since October 2013, after a fire ravaged through the structure.

The city has spent around 1.3 million dollars battling CN over this issue.

CN is said to be reviewing the decision.
