(SIOUX LOOKOUT, ON) – Appearing in courtroom 104 on Sunday, September 2, 2018 of the Thunder Bay Courthouse via video from the Sioux Lookout OPP detachment is 31-year-old Mike James Binguis.
Her Worship, Justice of the Peace Denette Maslach is presiding, along with Provincial Crown Attorney Andrew Sadler and duty counsel lawyer Aranka Golphy.
Binguis is alleged to have broke someone’s nose while already on probation. He is charged with the following two charges:
- Assault causing bodily harm
- Breach probation order (keep the peace and be of good behaviour)
The Crown is opposed to Binguis’ release, and indicates that he has a significant criminal record, which includes violence and breaches.
Furthermore the Crown states that there are concerns surrounding the secondary grounds, and that he is not consenting to his release.
Secondary grounds indicates that the crown believes that the likelihood of Binguis to either reoffend or become a public safety concern is substantial.
The Crown requests a 516 sub 2 order, in the name of the complainant. This means that while in custody, Binguis is not to contact the complainant.
Her Worship remands Binguis into custody pending a Tuesday court appearance.
