(FORT FRANCES, ON) – Appearing in courtroom 104 of the Thunder Bay Courthouse this morning via video from the Fort Frances OPP Detachment is Cliffton Tuesday.
Her Worship, Justice of the Peace Denette Maslach is presiding, along with Provincial Crown Attorney Piera Pasloski and a duty counsel representative is also present.
Tuesday is facing a few charges today in court, which are:
- Failure to appear in court
Tuesday has charges already going through court, those outstanding charges are:
- Theft under $5000
- Possession of property obtained by crime
The Crown is not consenting to Tuesday’s release today and indicates that this is a reverse onus situation.
A “reverse onus” situation means that it is on the accused to show why they should be released from custody. “Reverse onus situations” are situations such as, someone was already on bail conditions from previous charges, and was released, or is on a probation order, etc.
Tuesday chimes in and indicates to the court that duty council is representing him for his existing charges and that the duty council representative had told him that he did not need to go to court that day, and that’s why he did not go.
The duty council representative in court asks to remand Tuesday, to Fort Frances bail court on Tuesday.
Her Worship Maslach remands Tuesday to Tuesday in Fort Frances.
