26 POLICE INTERACTIONS, FINALLY CHARGED

(RED LAKE, ON) – Appearing in courtroom 104 of the Thunder Bay Courthouse for W.A.S.H. (weekend and statutory holiday) court from the Red Lake Ontario Provincial Police detachment is a youth D.H.

His Worship, Justice of the Peace Marcel Donio is presiding, along with Crown Attorney Derek Silvestro and duty counsel lawyer Lianne Roberge.

D.H. is charged with:

  • Mischief under $5000

ALLEGATIONS

D.H., as a young person has had 26 separate interactions with police in 2018 alone. The youth has been found completely intoxicated, and on a separate incident had stolen a vehicle and driven to Kenora.

No charges were pressed from any of the 26 interactions.

An incident occurred on Saturday, August 25th. The youth was witnessed on video surveillance footage at a local community building throwing rocks at windows, and picking up and smashing flower pots on the ground before fleeing the scene.

On August 28th at 2:38 am the youth’s parent was advised of the charge and the conditions police wanted to be set through courts.

August 30th, police made multiple attempts to locate the youth at their residence but were unable to.

September 7th, Red Lake OPP received information that the youth was at a local motel, and upon police arrival at the motel, the youth was taken into custody.

CROWN POSITION

The Crown indicates that as always with a youth, it is a Crown onus situation. He recommends release on the following conditions:

  • Reside with parent/guardian
  • Not attend 1 specific address
  • Abide by the rules of their residence
  • Keep the peace and be of good behaviour
  • No contact with 1 person
  • A curfew of 9 pm to 6 am
  • No alcohol or substances banned under the Controlled Drugs and Substances Act, unless with a prescription

The youth’s parent is not present at the Red Lake detachment, but the parent has been notified, and the officers at the detachment are willing and able to drive the accused home after court.

Duty Counsel requests a future court date for the matter to be addressed.

His Worship, Justice of the Peace Donio orders the youth released on an undertaking, with the Crowns list of conditions granted.

The youth is believed to have been transported home to their parent by a OPP officer.
