Aggravated assault, mischief, causing a disturbance, assault and failing to appear in court

(COUCHICHING, ON) โ€“ This weekendโ€™s W.A.S.H. court has cleansed the region of some outstanding warrants in and around the Thunder Bay district. A 36-year-old Lloyd Robert Kabatay wound up in the custody of Treaty Three Police.

Cabatay appeared in a Thunder Bay Courthouse this morning via telephone from the Couchiching detachment of the Treaty Three Police Service. Justice of the Peace Jennifer Neill was presiding.

Crown Attorney P. Pasloski was also assisting dishing out justice, along with a duty counsel representative.

Kabatay is facing the following criminal charges:

  • Failure to appear in court contrary to section 145(2)(a) of the Criminal Code of Canada x3
  • Aggravated Assault contrary to section 268 of the Criminal Code of Canada
  • Causing disturbance, indecent exhibition, loitering, etc. contrary to section 175(1)(a) of the Criminal Code of Canada
  • Assault contrary to section 266 of the Criminal Code of Canada
  • Mischief causing damage under $5000 contrary to section 430(4) of the Criminal Code of Canada

Canadaโ€™s Criminal Code describes what an aggravated assault means like so:

Every one commits an aggravated assault who wounds, maims, disfigures or endangers the life of the complainant.

Section 175(1)(a) of the Criminal Code,ย Causing disturbance, indecent exhibition, loitering, etc. is described as:

Every one whoย not being in a dwelling-house, causes a disturbance in or near a public place,ย by fighting, screaming, shouting, swearing, singing or using insulting or obscene language,ย by being drunk, orย by impeding or molesting other persons,ย is guilty of an offence punishable on summary conviction.

Mischief generally means that the accused may have broken something or willfully damaged something and a monetary amount has been set as the amount the alleged victim will have to pay to reverse the damage.

Kabatay was denied bail today and has been scheduled to appear in a Fort Frances bail court on Monday where he will have another chance at getting released.

  1. 3 counts of fail to appear and they are giving him a bail hearing? A judge would have to be brain dead to grant him bail.
