(THUNDER BAY, ON) – It’s Sunday today, and that means another session of W.A.S.H. (weekend and statutory holiday) court. The regions bail matters all get forwarded to Thunder Bay as all the other courthouses are stood down for the weekend.
First up on today’s docket is a 38-year-old Richard Nicolas Surdyka who is facing multiple charges from an incident over a month ago. Her Worship, Justice of the Peace Jennifer Neill was presiding along with Crown Attorney A. Mason and a duty counsel representative. He appeared by video while in police custody at the Thunder Bay Police Service station located at 1200 Balmoral.
Surdyka is facing the following criminal charges:
- Mischief causing damage under $5000 x2
The Criminal Code of Canada describes assault as Every one who commits an assault is guilty of an indictable offence and is liable to imprisonment for a term not exceeding five years; or an offence punishable on summary conviction.
Mischief causing damage under $5000 is described by the Criminal Code of Canada as Every one commits mischief who wilfully destroys or damages property; renders property dangerous, useless, inoperative or ineffective; obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property.
He is granted bail under the following conditions:
- Reside at a residence on Primrose Street
- No contact with one person
- Not to be within 100 meters of anywhere that same person is expected to be
- Not attend an address on Pearl Street
- Not to buy or possess alcohol or other intoxicating substances
- Not to possess any weapons as described by the Criminal Code of Canada
Surdyka has a future court date of January 11th, 2019 where the process of answering to the charges will begin. He is escorted back to his jail cell at the police station where he will wait for the bail-related paperwork to be completed and sent over from the courthouse before he can be released.
