(THUNDER BAY, ON) –THE INFAMOUS ENGAGEMENT RING FROM THE HOBBS VIDEO SHOOT OF SANDY ZAITZEFF.
20 000$ RESTITUTION ORDERED PLUS 4 MONTHS LESS 1 DAY IN JAIL FOR ONE MAN INVOLVED.
THE ACTUAL THIEF GETS DIVERSION.
Appearing in Courtroom 102 on Friday, Marc1, 201919 to plead guilty and be sentenced before Her Honour, Justice Elaine Burton is a handcuffed 33 year old ANTOINE BOUCHARD (pictured left).
Crown Attorney Katrina Van Kessel and Defence Attorney John De Bakker are present.
THE STORY OF THE RING
On or about October 25, 2016, a video is recorded showing what court documents call “an intoxicated Alexander Sandy Zaitzeff” proposing marriage to Heli Kijanen.
The video shows that Keith Hobbs was present when it was shot, among several other people. Marisa Hobbs was operating the video camera.
On December 19,2017, a now 49-year-old DAVID KIJANEN(pictured right) (brother of Heli) was arrested by Thunder Bay OPP and charged for stealing two rings. One gold ring with pearls embedded on it. The other is the infamous engagement ring that Sandy Zaitzeff presented in the now famous Hobbs-Zaitzeff video. The ring is appraised at $15,000. The court is told that both rings are appraised at a total of 27 500$.
DAVID KIJANEN remained free on a Promise to Appear. On Tuesday, February 26,2019, KIJANEN had his theft over 5000$ charge officially withdrawn in court and was sent to Diversion. Generally, Diversion is only eligible for minor offences and it is only available to persons who have no previous criminal record. The Crown recognizes that not all types of offences need to be dealt with through guilty pleas or trials, and that sometimes helping out in the community can make up for harm caused by an offence.
Generally, diversion involves an accused person doing something outside of court in order to have a charge (or charges) stayed or withdrawn by the Crown.
IT IS NOT KNOWN WHAT TYPE OF DIVERSION THAT DAVID KIJANEN WAS SENT FOR. But he remains without a criminal record.
According to admitted facts in court. Police became aware that DAVID KIJANEN traded the stolen engagement ring with ANTOINE BOUCHARD for a quantity of illegal drugs.
BOUCHARD then tried bringing it to Big Ed’s Pawn Shop. The owner of Big Ed’s felt that BOUCHARD may have illegally acquired the ring and refused to purchase it. Thunder Bay Police became interested and attended the store and reviewed the video footage.
ANTOINE BOUCHARD was arrested and charged by police with possession of stolen property but police never retrieved the rings.
NO ONE KNOWS WHERE THE RINGS ARE.
BOUCHARD admitted that he had the engagement ring but doesn’t know where it is now.
On April 24,2018 Bouchard was sentenced to 12 months probation for a previous mischief conviction. He reported to his probation officer the next day but then failed to report a couple of times in May 2018 as he was directed to do. He was charged for that.
In November 2018, BOUCHARD failed to attend court. A bench warrant was issued for his arrest.
AGAIN, THE DIRECTOR OF COMMUNICATIONS AT TBPS FAILED TO NOTIFY THE PUBLIC OF THE ARREST WARRANT
On January 10,2019 at the Arthur Street Walmart, BOUCHARD was observed grabbing a Booster Juice and putting it in his backpack. He also stole 2 DVD’s and placed them in his coat and left the store. Loss Prevention Officers intervened and Thunder Bay Police showed up to execute the arrest warrant. He was denied release and taken to Thunder Bay Jail.
BOUCHARD is a member of the Rocky Bay 1 Indian Reserve. His mother attended residential school and was an alcoholic. His father was a drug addict. BOUCHARD started using drugs at an early age. In 2011, he entered the methadone program and has had several relapses. He has been employed over the years in diamond drilling and roofing. He has the background to work for a living.
Lawyer John de Bakker has worked out a pretty good deal for his client considering the length of his record.
BOUCHARD has spent 51 real days in jail which is enhanced to 77 days. He has several criminal convictions on his record. He’s being sentenced to an additional 4 months less 1 day in jail on top of those 77 days for all these crimes. He’s also ordered to provide a DNA sample
A 20 000$ stand alone restitution order is issued for BOUCHARD to pay to HELI KIJANEN for the engagement ring. KIJANEN submitted a victim impact statement to the court.
WRITER’S NOTE: I’m not sure why KIJANEN should get the money when it was ZAITZEFF who paid for the ring on the promise of marriage that went unfulfilled by KIJANEN.
