Feb 23/17. A 30 year old Tyson Spence was scheduled for trial all last week. He changed his mind to plead guilty on 4 counts. The 5th count was withdrawn by the Crown. Judge Dan Newton is presiding over the hearing. Crown Attorney is Shari Frenette and Spence is represented by lawyer Christopher Avery from Toronto. There are 3 people here in the body of the court. The Native Court Worker, the Gladue Report Writer and myself. Spence has been in custody since the incident, heโ€™s handcuffed and in the prisonerโ€™s box. He is wearing dark clothing and has no expression or emotion being shown.

A very lengthy statement of admitted facts are read into the record on February 17,2017. The following is a highlight of some of those facts.
On January 3,2015 just before 1 p.m. a suspicious man was seen on the property of a John St Road residence. The 63-year-old victim who worked in a nearby Esso went to check on the situation.

He found Spence inside the home. Spence had a duffel bag stolen from the home containing items he was stealing. The victim asked Spence โ€œWhat are you doing?โ€

Spence replied โ€œIโ€™m doing a B & E, what the f**kย does it look like Iโ€™m doingโ€.

Spence then attacked the victim by striking him in the head over and over with his fists.

The victimโ€™s ex-wife was across the street at the Esso and she became concerned with the length of time the victim was gone. She alerted 2 plainclothes police detectives who happened to be at the business. They drove across to the victimโ€™s residence where they could hear what was described as โ€œdeath blowsโ€ being struck.

They looked over a fence and recognized Tyson Spence from previous criminal encounters who was striking the elderly victim repeatedly in the head and the victim was bleeding heavily.

The officers announced their presence to Spence and told him he was under arrest. Spence refused to surrender and grabbed the duffel bag of stolen items and tried to run. He was able to slip past one officer but the other caught him and Spence violently fought back. Officers were required to use force to detain Spence. They had difficulty getting him under control. Spence is fairly stocky and strong. Another friend of the victim had happened to come by while police were struggling with Spence. The officers directed him to tend to the victim. These plainclothes detectives did not have a police radio on their person and had to use a cell phone to call for support.
The victim suffered some very traumatic head injuries. Multiple fractures and surgeries. He had a surgery last month and still requires more surgeries. Horrific injuries. Throughout the entire reading of admitted facts, Spence shows no emotion. Itโ€™s the same stone cold look.

Judge Newton accepts the guilty pleas and admitted facts and registers the conviction. February 27,2017 will be to Set Date for sentencing. Spenceโ€™s lawyer requests the Gladue Report and Pre-Sentence Report.
The Crown Attorney is seeking a penitentiary term for Tyson Spence.

Court is declared closed and the Gladue Worker & Native Court Worker who are sitting directly behind Spence rise to speak to him. They seem to be consoling him.

Writerโ€™s Note :

Not sure why any other media was not present. They were all quick to announce charges but couldnโ€™t be bothered to follow up.
Iโ€™ve sat in a lot of court proceeding over the years but this one will stick in my mind on the brutality of this attack. Had those Thunder Bay Police Detectives not arrived when they did, weโ€™d be hearing about someone who was deceased.

  1. Man he is tough!
Beating the crap out of a 63 year old man.
Whew. A real piece of work here.
Its an awful shame the officer’s weapon didn’t “Accidentally” discharge, right behind the piece of s***s temple.
    Maybe next time.
With a little luck, the gents in the jail will provide him a warm welcome.

  2. Repeat violent offenders like this shouldn’t be released from prison. They’re nothing more than vicious, brutal animals and should be locked up for life. However, when our judges release known murderers for technicalities, there’s not much chance extremely violent offenders will get the punishment they deserve. Not in this town with such limp waisted justices.

  3. Anyone with a “Space Invaders” tattoo, needs help.
Obviously this guy needs another back eye from a senior citizen.(and more)

    1. Coming from a guy who was issued a removal order from Canada? Weren’t you charged w death threats also?

  4. Calling this guy an animal is degrading to animals.

Just a low-IQ goof that will never fit into society – his only discernible skill is being a thief, which even that he can’t manage.

  5. Pretty tough guy. So far he beat up a senior and a woman. Took big balls to muster up the courage to take them on. Toss the piece of crap in jail and hopefully some one will show him how his victims felt.

  6. Back in th 50โ€™s, they use to apply electroshock therapy to aggressive people like this. Sometimes a lobotomy when electroshock wouldnโ€™t work. Unfortunately, itโ€™s too inhumane to perform these tasks today. Then again, the patient would need a brain and this guy seems to be lacking one.

  7. Real tough guy! Beating up elderly and women. Why doesn’t this useless POS pick a fight with someone who could fight back?! Is he scared his ego would burst once he got beat up?! I know several women that would beat him senseless let alone some of the men I know. Put this waste of air consuming flesh in jail and let him become someone’s girlfriend!

  8. Actually as for this new charge for beating up a woman ,it’s was the girl who he was dating and she was always coming over to visit Tyson (at his mom’s house where he is living) and each time she was visiting him Tyson mom would notice that her pain medication and money from her purse gone and then his mom went to ask who stole my stuff and that is when Tyson grabbed his gf bag and looked in it and sure enough his mom’s stuff was in it and he dumped her and his mom said she was calling the cops and reporting that the gf stole her medication and bank card and. Cash then Tyson gf said if I get charged for this Tyson I swear to God I will make sure that the cops arrested u to and him and his mom said he never did anything and his gf said I will say that you raped and beat me up I promise you and no one will believe that u didn’t do it cause everyone thinks that you are a horrible guy who beat a elderly person so they will take my story and not listen to u

  9. Wowsers!!!!!! I can’t recall a story that generated a number of responses not only that were all similar in nature but that I was in total agreement with each and every one of them.

But Rex you hit it on the nail about our Judges and Justices often making poor judgements on some of these creeps or the plea deals being made. What is this enhanced crap 1 1/2 days for each day served. Maybe we should try 1/2 day for each day served. Such bs.

Maybe if these pieces of crap did some home invasions and B & E’s closer to the homes of some of these decision makers in our court system they wouldn’t be so quick to be sympathetic or considerate to these jerks. Maybe, just maybe they would think long and hard about giving them more appropriate sentences for what these thugs are doing to our seniors and women of this town and forget this leniency crap.
Judges and Justices, how would you be feeling right now if it was your father or maybe your daughter that this asshole
beat up to this degree. Bet you leniency would not come to mind. Well remember, they are our fathers and daughters.

  10. Miss Thompson appears to be infatuated with this man. Give your head a shake. Heโ€™s a repeat criminal offender and if the story you gave is true, then they should have called the police. If this gf was caught red handed, they could have used necessary means on their property to hold the person until police arrived. Other than that, heโ€™s still a criminal and has violent tendencies. If youโ€™re sleeping with him, you should sleep with one eye open! Heโ€™s a juicer and Iโ€™d like to see what federal penitentiary life would bring him cause thereโ€™s bigger boys out there that would love to play with him.
