(THUNDER BAY, ON) – MAN SENTENCED TO 3 MONTHS HOUSE ARREST FOR STEALING FROM HIS OWN GRANDMOTHER.
ALSO GETS 9 MONTHS PROBATION AND IS ORDERED TO PAY HIS GRANDMOTHER BACK.
Appearing in Courtroom 102 before His Honour Gary Kunnas today is 39 year old NICHOLAS BURCHAT.
BURCHAT is being represented by Defence Attorney Ryan Green. Crown Attorney Andrea Mason is here to prosecute.
BURCHAT is about 6 feet tall, over 200lbs with unkempt hair. He has scruffy facial hair. He’s wearing a thick gray hoodie and dirty blue jeans.
BURCHAT plead guilty a few weeks ago to theft under 5000$.
BURCHAT’S grandmother is in the body of the court. She is the victim of the theft. She has other family with her.
Court hears that BURCHAT made two electronic money transfers from his grandmother’s account to his own on April 30,2018. The amounts were $400 & $500
BURCHAT made another money transfer on May 2,2018 for $500.
Police were called once the elderly victim became aware of the theft. Police investigated and approached BURCHAT who agreed to repay grandmother the entire amount by May 30,2018.
That date came and went. Thunder Bay Police laid the theft under $5000 charge against BURCHAT.
The court hears that BURCHAT has saved $300 to repay his grandmother. That money is being held in a trust by his lawyer Ryan Green.
BURCHAT’S claim is that he stole grandma’s money because he was in fear for his life from some drug dealers he owes money to.
BURCHAT claims he’s done treatment on his own and is good now.
His grandmother is given the opportunity to address the court but she declines. However, she does convey to the Crown that this wasn’t the first time this happened. She is of limited means and this affects her a lot.
BURCHAT is offered a chance to speak by His Honour Kunnas. He stands to tell the Judge that he’s sorry.
His Honour directs BURCHAT to address his apology towards his grandmother. BURCHAT turns his head a states a very quick “I’m sorry”.
The joint submission is for a 3 month conditional sentence order (house arrest).
BURCHAT is required to stay at his apartment in the 300 block of Simpson Street. He has a 9pm to 6am curfew. He must make monthly payments to his grandmother of $100.
Justice Kunnas orders the $300 in trust to be paid to the elderly victim within 7 days.
BURCHAT tells the court he only gets $342 a month. He asks if his first payment can be $50.
His Honour allows it. But it’s a condition of his CSO and 9 months of probation to make monthly payments to his grandmother and make her whole again.
BURCHAT has acquired several convictions for theft.
Inside Edition sources indicate BURCHAT is the father of 3 children with 2 mothers. He pays no support, and has no custodial or access rights to any of his children.
