Drugs, a Gun, and an Atikokan Resident Getting Arrested.

(POWASSAN, ON) โ€“ At approximately 1:25 p.m., on April 10, 2019, officers from the North Bay Detachment of the Ontario Provincial Police (OPP) stopped a vehicle for a traffic offence on Highway 11 in Powassan, Ontario.

Upon speaking to the vehicle occupants, police began an investigation.ย Officers located a loaded handgun and drugs suspected to be:

  • Cocaine.
  • Crack.
  • Morphine and;
  • Cannabis.

As a result, the driver and passenger were arrested.

Rafael DELEON, age 22, of Mississauga, Ontario, has been charged with the following:

  • Possess Firearm or Ammunition Contrary to Prohibition Order contrary to section 117.01(1) of the Criminal Code (CC);
  • Possession of Proceeds of Property Obtained by Crime under $5000 contrary to section 354(1)(a) of the CC;
  • Careless Storage of a Firearm contrary to section 86(1) of the CC;
  • Unauthorized Possession of a Prohibited or Restricted Firearm contrary to section 91(1) of the CC;
  • Knowledge of Unauthorized Possession of a Firearm contrary to section 92(1) of the CC;
  • Occupant of Motor Vehicle Knowing there was a Firearm contrary to section 94 of the CC;
  • Possession of a Loaded Prohibited or Restricted Firearm contrary to section 95(a) of the CC;
  • Possession of a Schedule I Substance contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA);
  • Traffic in Schedule I Substance contrary to section 5(1) of the CDSA;
  • Possession of a Schedule I Substance for the Purpose of Trafficking contrary to section 5(2) of the CDSA; and
  • Drive Motor Vehicle โ€“ No Licence contrary to section 32(1) of the Highway Traffic Act (HTA).

Heather SMITH, age 28, from Atikokan, Ontario, has been charged with the following:

  • ย Possession of Proceeds of Property Obtained by Crime under $5000 contrary to section 354(1)(a) of the CC;
  • ย Careless Storage of a Firearm contrary to section 86(1) of the CC;
  • Unauthorized Possession of a Prohibited or Restricted Firearm contrary to section 91(1) of the CC;
  • Knowledge of Unauthorized Possession of a Firearm contrary to section 92(1) of the CC;
  • Knowledge of Unauthorized Possession of Weapon contrary to section 92(2) of the CC;
  • Occupant of Motor Vehicle Knowing there was a Firearm contrary to section 94 of the CC;
  • Possession of a Loaded Prohibited or Restricted Firearm contrary to section 95(a) of the CC;
  • Possession of a Schedule I Substance (two counts) contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA);
  • Traffic in Schedule I Substance contrary to section 5(1) of the CDSA; and
  • Possession of a Schedule I Substance for the Purpose of Trafficking contrary to section 5(2) of the CDSA; and
  • Permit Unlicensed Person to Drive contrary to section 32(10) of the HTA

Both accused persons have been held pending bail and are scheduled to appear in the Ontario Court of Justice in North Bay.

  1. Excellent job by the police department. I like to see the drug dealers get what they deserve. The biggest problem is they will get bail and continue the exact lifestyle without any accountability or second thought. The laws need to change in a major way.
