Assault with a Weapon, Aggravated Assault, and More

(COUCHICHING, ON) โ€“ The quiet town of Fort Frances and neighbouring communities appear to be getting the same social issues as Thunder Bay is experiencing, everything from โ€œcrimes of opportunityโ€ orchestrated by out of control drug addicts to violent crime.

Appearing in a Thunder Bay bail court this morning via telephone from the Couchiching detachment of the Treaty Three Police Service is Ashley Archie. Her Worship, Justice of the Peace Jennifer Neill is presiding along with Crown Attorney Delaney and duty counsel lawyer Morris.

Archie was arrested on the strength of a warrant. She has been wanted for an unknown amount of time. Her new charges are:

  • Assault with a weapon.
  • Something to do with a credit card, the Justice of the Peace was not clear enough for me about this when she read it out.

Archie has an outstanding matter before the courts already working its way through from an incident on July 11th. That charge is Aggravated Assault.

The Crown states that they cannot move forward on this release plan due to the previous bail papers not being before the court. There is not enough information in the Crownโ€™s hands to know if release should be granted or not. Also, Archie finds herself in a reverse-onus situation and the Crown has concerns on the primary and secondary grounds. Primary ground concerns indicate the Crown believes there is a substantial risk that the accused will not show up for court. Secondary ground concerns indicate that the Crown believes that the accused may become a public safety concern or reoffend should they be release.

There is no consent to release granted by the Crown.

Duty counsel requests the matter be remanded into a Monday morning bail court in Fort Frances for Archie to have another chance to get released. The request is granted and Archie is ordered to remain in jail until at least Monday.
