(THUNDER BAY, ON) – Appearing in a Thunder Bay bail court this moring was 45-year-old Phillip James Andy. His Worship, Justice of the Peace Denette Ellard was presiding along with Crown Attorney VanKessel and duty counsel lawyer Atatise.
Andy is facing the following criminal charges that stem from a July 15th incident:
- Sexual Assault.
- Forcible Confinement.
- Choking with intent to commit sexual assault.
The Crown states that although this is a Crown-onus situation, the Crown intends to detain Andy. Allegations are that this was a violent sexual assault and that the accused and victim are unknown to each other. Further, a no-contact order is requested by the Crown to be placed on Andy to not contact his alleged victim.
Duty counsel tells the court that he will send Andy’s lawyer the updated information and requests a remand to tomorrow to allow for a bail plan to come together.
Andy is escorted back to his cell at the Thunder Bay Police Service station (hotel balmoral) where he will wait to be transported to the Thunder Bay District Jail A.K.A. “The Algoma Bed & Breakfast”.
