MARATHON OPP ARREST MAN FOR ALLEGEDLY ASSAULTING AND CHOKING WOMAN AFTER RIPPING HER CABINET DOORS OFF.
DUTY COUNSEL APPEARS TO BE “CHOKING” IN COURTROOM
Marathon OPP arrested 36 year old CORY ANDREW EXELL early this morning, Sunday March 31,2019.
Marathon OPP working hard as usual.
OPP responded to a call on Hemlo Drive after medical services responded to a woman for injuries sustained in an alleged attack by EXELL.
It’s alleged that EXELL became upset and began ripping off cabinet doors. He then allegedly pushed the woman into the wall several times before putting his arm around her throat to choke her.
EXELL is further alleged to have stolen $300 cash, sunglasses, mail and house keys belonging to the woman
EXELL appeared by video in W.A.S.H. (Weekend And Statutory Holiday) Court this morning before Justice of the Peace Bruce Leaman.
Duty Counsel Joy Wakefield requests a Section 517 publication ban. But Crown Attorney Rob Kozak is consenting to release on an undertaking.
His Worship Leaman points out to the young Duty Counsel that a Section 517 can only be ordered when the Crown intends to show cause to detain.
Duty Counsel Wakefield tries to cite the Supreme Court case of Toronto Star. But she doesn’t seem to be aware of anything else.
His Worship says it does not apply to a consent release.
DUTY COUNSEL APPEARS TO BE STRUGGLING.
Duty Counsel Wakefield is stuttering to try answer.
She has no law based answer.
She says she will need to check her email. She’s given the opportunity to talk to EXELL.
Wakefield returns and states she would like time to research the matter. Seems the young Duty Counsel didn’t prepare for this moment.
EXELL remains in Marathon OPP jail while Duty Counsel Wakefield tries to find some valid reason for a publication ban.
The matter will return to court later today.

UPDATE: 11:35 am. Duty Counsel Wakefield took an hour to search for an answer. She cites paragraphs 33,34,39 and 160 of the Toronto Star case as justification for a publication ban. His Worship Leaman orders the Section 517 publication ban. No evidence or testimony can be published until the trial starts.
