FREEMAN OF THE LAND HAS BEEN FREED …..ON 650$ DEPOSIT BAIL WITH CONDITIONS
Appearing handcuffed in Courtroom 104 this afternoon Monday, April 16, 2018, before Justice of the Peace Denette Maslach is 49-year-old Shannon James McCardle. Crown Attorney Mary Ann Mackett and Duty Counsel Arturo Acosta are also present.
McCardle looking pretty rough since the last time I have seen him. But he’s here for a Bail Hearing. McCardle stands about 6 feet tall and appropriately 200 lbs.
The court hears allegations that on April 7, 2018, at 11:54 am the Nipigon OPP pulled over an Enterprise rental vehicle with Alberta plates doing 95km/h in a 70km/h zone. The male driver (later identified as Shannon James McCardle) stated he did not recognize officers of the law and refused to identify himself. A female passenger was present.
Police attempted numerous times to convince him to comply. A Sergeant arrived with another cruiser and ‘boxed’ McCardle in. A spike strip was put in front of the tires in case he decided to flee the scene. At 12:28 pm, Nipigon OPP arrested him for Obstructing a Police Officer.
The female passenger 39-year-old Shannon Rempel of Amherstburg, Ontario was released after she produced a valid driver’s license and rental agreement for the vehicle at 1:35 pm.
MANIFESTO SEIZED BY POLICE.
Court hears that the OPP took a manifesto from the vehicle. Thunder Bay Courthouse-Inside Edition has obtained a copy of that manifesto and has attached it to this post.
IDENTIFICATION BY POLICE.
Court hears there is a large tattoo on his back that says “McCardle” and it has wings. On April 8, 2018, at 6 pm, Nipigon OPP received a call from someone in Pennsylvania stating the person they had in custody was quite possible SHANNON JAMES McCARDLE. Police did a check and found McCardle’s picture from RCMP in Surrey, BC.
There is an arrest warrant there for McCardle from an alleged incident on September 9, 2015, for assaulting and obstructing a police officer. He has no previous criminal record. But he has been detained previously on mental health issues and uttering threats.
On July 24, 2017 McCardle let his British Columbia driver’s license expire. No reason is stated.
Crown Mackett does not want him released, but Duty Counsel Acosta is arguing that McCardle was practicing his religion, albeit a bit zealous, as a reason why he was arrested.
Acosta suggests to the court that McCardle has been in jail for 10 days now, and that McCardle is unlikely to receive a sentence that long if convicted. He’s proposing a deposit bail with surety.
Her Worship Maslach needs time to consider.
Her worship tells McCardle “You’re entitled to have your own views, sir, that’s what Canada is all about.”
She has reviewed the required case law and even cites the MEADS v. MEADS decision from Alberta in making her decision.
McCardle can be released on 650$ deposit bail. Conditions are he must not drive. He must report to Amhurstberg Police twice a week on Tuesdays and Fridays. He will be subject to door knock compliance checks and he must report to Nipigon OPP on arrival for court appearances. His next court date is June 12, 2018 in Nipigon.

INTERVIEW AFTER RELEASE
I greet McCardle as he’s exiting the courthouse with his female companion. They seem happy now. I ask him if he got assaulted in jail, but he informs me that the microwaves have infected him. But he insists that he ‘just took down the Crown’.
I try to remind him that he just received bail. He tells me the angels will protect him again and that he’s glad to get out of Thunder Bay……” there are bad vibrations and karma here” But he also insists there were a lot of nice Correctional Officers at the Thunder Bay Jail. I couldn’t argue that last point with him. I wish them safe travels and remind them not to speed through Nipigon.
