(THUNDER BAY, ON) – A 41-year-old Mark Bax appeared in a Thunder Bay bail court this morning via video link while in police custody at the Thunder Bay Police Service Station (A.K.A. “Hotel Balmoral”). Officers have arrested him after a September 19th incident in which it is alleged he damaged a door lock plate, door frame, picture frame, microwave and Samsung laptop, which is the property of a woman.
Justice of the Peace Bernard Caron, Crown Attorney Derrick “The Hammer” Silvestro and duty counsel lawyer Robert Habjan were working the courtroom this morning, administering justice.
Bax’s new charge from this incident is:
- Mischief causing damage.
Court hears that Bax has some outstanding charges already working their way through the criminal justice system.
The Crown states that this is a reverse-onus situation, meaning Bax would have to show the court why he should be released. Bax has pleaded guilty on at least some of his outstanding charges, in which he is awaiting a lengthy penitentiary sentence. His next appearance on those matters are Monday, September 23rd, 2019. The Crown suggests that Bax be held in custody and appear on Monday as scheduled.
Bax states “Your honour, I have my own place I don’t have to go back to that address, I have my own address” he further indicates that he has a job on Tuesday that he has to go and “look at”. He further states that he has been in numerous programs, such as counselling and other things “in progress here”.
The Justice of the Peace asks the Crown if this new information provided by Bax has changed his position regarding his release, the Crown indicates that his position remains firm, and hammer-like.
Duty counsel tells the court that he was informed by officers that Bax has refused assistance from duty counsel.
The Justice of the Peace orders Bax to be held in jail until at least Monday, where he will have his next occurence. Bax starts to have some heated discussions with the police in the police station while still on camera. The Crown Attorney states that “we are done”, indicating that the next prisoner needs to come before the courts. Bax appears to lose his shit, spits towards the camera and shouts “F**KIN SCUMBAG GOOF” as he gets escorted away by police. Some ruckus is heard coming from off-camera at the police station and it sounds like something was smashed. The Crown Attorney states that it “sounds like another mischief charge”.
Bax is scheduled to appear in court on Monday to continue working his criminal matters through court.

BAIL HEARING DECISION ON MARK BAX MONDAY MAY 7,2018
A 3 hour Bail Hearing was held last week for 40 year old Mark Bax before Justice of the Peace Bruce Leaman. Federal Crown Attorney Alec Hardiejowski and Defence Lawyer George Joseph were present.
A publication ban on all evidence and reasons from the hearing is in place.
Decision came this morning from His Worship Leaman. BAIL IS DENIED FOR MARK BAX.
HIS CO-ACCUSED 24 year old AMANDA DESAULNIERS REMAINS FREE ON BAIL. BAX IS RETURNING TO THE THUNDER BAY JAIL.
His next court appearance will be this Friday May 11,2018 by video to set date for Preliminary Hearing.

WEAPONS AND DRUG ARRESTS

On the 8th of July 2017 just after 12:00 pm Thunder Bay Police Service Officers attended at a South side Hotel for a disturbance.
As a result of the initial complaint the Intelligence Unit executed two Controlled Drug and Substances Act Search Warrants.
More than $178,000 in illegal narcotics was seized including Crystal Methamphetamine, Methamphetamine, Crack Cocaine, Cocaine, Oxycodone pills, Xanax Pills, Psilocybin and Cannabis Resin.
A loaded shotgun, various imitation handguns, machine guns, and body armour were also located.
Mark Bax, 39, faces 16 drug trafficking and weapons charges, along with breach of probation.
Amanda Desaulniers, 23, is charged with trafficking cocaine and unsafe storage of a firearm.
Both have been remanded into custody.
BAX & DESAULNIERS are in a relationship together.
