Police Arrest Man for Assault with a Computer

(THUNDER BAY, ON) – Hardworking officers with the Thunder Bay Police Service have arrested and held in custody a 44-year-old James Burrows after they responded for a call for service in the early morning hours of October 13, 2019. An investigation was initiated and as a result of that investigation and assault with a weapon charge was laid.
Burrows appeared in a Thunder Bay Courthouse (A.K.A. “The In and Out Day Spa”) courtroom this morning via video link while in police custody at the Thunder Bay Police Service station (A.K.A. “Hotel Balmoral”). He appeared in front of His Worship, Justice of the Peace Marcel Donio, Crown Attorney P. Pasloski and criminal defence lawyer Aranka Golphy who was filling the role of duty counsel this morning.
Court hears the Crown say that Burrows is in a Crown-onus situation, and although he is likely releasable, they still need to seek victim input before a proper bail plan could be put together. Further, the Crown is recommending a surety-release. A Crown-onus situation means that the Crown will have to show the courts why an accused should be held in jail.
Criminal defence lawyer Aranka Golphy, who is performing the role of duty counsel this morning tells the courts that Burrows is employed and has nothing on his criminal record since 2007. She presses for a bail hearing to be held on Tuesday, October 15th, 2019. Further, Golphy tells the courts that it is duty counsel’s position that a surety-release is not needed in the case of Burrows.
The Justice of the Peace orders Burrows to remain in jail until at least Tuesday, where he will have another swing at bail. A surety is someone who signs up to watch the accused after they are released. When someone is released with a surety, the surety has to call police and report any breaches of their bail conditions should they happen. If the surety fails to report these breaches, they are subject to financial penalty and might not qualify as a surety in the future.
It’s likely that on Tuesday the Crown and duty counsel will have a contested bail hearing and battle over the conditions of Burrow’s release. He is highly like to be released at that date.
