AGGRAVATED ASSAULT, DEATH THREAT & BREACH OF BAIL CONDITIONS

(KENORA, ON) – Kenora OPP had to deal with a violent situation yesterday, as it is alleged that a 26-year-old Cody Joseph wounded a man, and made a threat to kill him.

Joseph appeared by video from the Ontario Provincial Police Kenora detachment to a Thunder Bay bail court this morning. Justice of the Peace Bernard Caron was presiding, along with Crown Attorney Gordon Fillmore and two duty counsel lawyers Arturo Acosta and Lianne Roberge.

The accused was already out on bail from a previous incident in which he was charged with theft. That matter was scheduled to be spoken to on October 11th.

Joseph’s new charges are:

  • Aggravated Assault
  • Uttering threats to cause death
  • Breach of bail conditions

Crown Attorney Fillmore stated that Joseph is in a reverse onus situation, which means that Joseph has to show to the court why he should be released. Fillmore continued and said that he intends to put Joseph to that onus.

A no-contact order is requested by the Crown, which would ban Joseph from contacting or communicating with two individuals.

Duty counsel requests an October 9th court date for return, so that Joseph may obtain legal counsel and begin building his bail plan.

Justice of the Peace Caron orders Joseph not to contact the two people named by the Crown, and also sends him back into custody until his October 9th court date.

Joseph is escorted back to his cell, where he will await prisoner transport to the Kenora District Jail. He will wait there until at least his October 9th appearance.
