Appearing in bail court this morning is Amber Towedo. Justice of the Peace Bernard Caron, with assistant Crown Attorney Ashton Brown and Duty Counsel James Lisowski.

Justice Caron addresses Towedoย asking a few times if she can hear him, she doesnโ€™t respond and he raises his voice and asked her if she can hear him, she responds with a with โ€œWho?โ€ฆ Me?โ€. Some quietย chuckles are heard in the courtroom as Justice Caron says โ€œyes, youโ€.

It is alleged that Towedoย had violated her previous bail conditions in which she was released on a recognizance. The breach was for not abstaining from alcohol and other intoxicating substances. Furthermore, while police were attempting to arrest her, she resisted a peace officer while engaged in his duties by removing her shirt and running away.

Towedoย has outstanding charges from aย previous incident. Those charges are:

Assault and assault with a weapon dating back to December 23rd, 2017.

Towedoย also has previous legal issues spawning from incidents in Thunder Bay and Greenstone which were a few breaches of probation, with a side of mischief.

The crown notes that this is a reverse onus situation and she has concerns regarding her release on the secondary grounds and indicates that there are primary concerns as well. Secondary grounds points to a substantial concern that the accused is likely to put the public safety at risk, and/or re-offendย if released. Primary grounds indicate that the crown is concerned whether or not the accused will attend court, should she be released.

The crown suggests remanding Towedoย into custody for a Monday bail hearing so that she may show cause to the court as to why she should be released, hopefully satisfying the crowns concerns

The crown suggests that while Towedoย is in custody, that she be ordered to not contacting or communicate with the two complainants involved in the charges.

Justice of the Peace Caron orders Towedo to be held in custody until Monday for her bail hearing, and also orders her to abstain from communications with the two complainants.

FEBRUARY 1,2018 ONE YEAR IN JAIL FOR ARSON.

A 22-year-old Monica Magiskan (pictured smiling on the left) appeared in handcuffs on February 1, 2018 before Judge DiGiuseppe. Sheโ€™s wearing a purple parka and has gained approx 25 lbs since sheโ€™s been in jail.

Sheโ€™s pleading guilty and going to be sentenced. She was arrested on January 3, 2018, in Longlac by the OPP. Court heard that her and 3 other individuals (charges have not been proven against other three).

Amber Towedo (pictured in white toque) Willa Bouchard and a Youth who cannot be identified went to a home in Longlac because they heard the homeowner was a โ€œratโ€ who was cooperating with authorities on a criminal investigation. Magiskan broke into the home but the homeowner quickly pushed the intruders out.

Magiskan pleads guilty to pouring gasoline on the homeownerโ€™s vehicle and setting it on fire. She has a criminal record and was released last year from jail on an 8-month sentence.

The gladue factor is that sheโ€™s a member of Aroland Indian Reserve 83.

The Crown originally wanted 2 years for these crimes. A joint submission by the Crown and her lawyer Gil Labine is for a sentence of 1 year in jail plus 1-year probation. Sheโ€™s been in custody for 30 days and it gets enhanced to 45 days credit. Sheโ€™s sentenced to 320 days jail, plus 12 months probation concurrent on all charges

The Judge asks her if she has anything to say. Magiskan responds that she knows what she did was wrong and hopes she is forgiven.

Judge DiGiuseppe reminds her that targeting an individual for retribution because they are cooperating with authorities is wrong.

Nothing has been proven in court yet against Amber Towedo, Willa Bouchard or the youth.

Magiskan has no emotion throughout the proceeding and is led out of court by the Special Constables to start her jail sentence.
