DOMINIC FORESTA – 40 ANIMAL CRUELTY CHARGES

(OLIVER PAIPOONGE, ONT) โ€“ 67-year-old Dominic Foresta has been charged with two counts of animal cruelty under the Criminal Code of Canada and 38 animal cruelty charges under the Ontario SPCA Act as a result of an investigation involving approximately 90 animals on a rural property.

On November 2, 2017 the Ontario SPCA charged Foresta of Oliver Paipoonge township with the following offences under the Criminal Code of Canada:

โ€ข Willfully permit to be caused unnecessary pain, suffering, and injury to an animal
โ€ข Willfully neglect or fail to provide suitable and adequate food, water, shelter and care

Foresta was also charged with the following offences under the Ontario SPCA Act:

โ€ข 6 counts of causing an animal to be in distress
โ€ข 7 counts of permitting an animal to be in distress
โ€ข 7 counts of failing to provide the necessary care for their general welfare
โ€ข 1 count of failing to provide adequate and appropriate medical care
โ€ข 1 count of failing to provide adequate and appropriate food and water
โ€ข 4 counts of failing to provide adequate and appropriate resting and sleeping areas
โ€ข 3 counts of failing to provide adequate and appropriate sanitary conditions
โ€ข 3 counts of failing to provide adequate and appropriate protection from the elements, including harmful temperatures
โ€ข 3 counts of failing to provide a pen or other enclosed structure or area, and any surfaces, structure and materials in it safe and non-toxic to animals
โ€ข 3 counts of failing to provide a pen or other enclosed structure or area, and any surface, structure and materials of a texture and design that will not bruise, cut or otherwise injure the animals

Foresta has appeared in court, and has a future court date of June 26th, 2018 at 9:30 am in courtroom 105.

After receiving information from an eye witness concerning the welfare of animals on a rural property, the Ontario SPCA was successful in obtaining a warrant allowing them to enter onto the property.

On September 28, 2017, an Ontario SPCA officer with the Thunder Bay & District Humane Society executed the warrant and discovered cattle, sheep, goats, horses, rabbits, dogs, pigs and turkeys living in deplorable conditions.

Two female dogs and 15 puppies from their respective litters, as well as a third adult dog suffering from untreated injuries, were found to be in immediate distress.

As a result, these dogs were removed at the recommendation of the attending veterinarian in order to provide necessary care and medical attention.

The adult dog suffering from untreated wounds had to be humanely euthanized, at the recommendation of a veterinarian, due to the severity of her injuries.

It is important for the public to understand that proper legal procedures must be followed in order to gain legal access onto an individualโ€™s property, which then allows us to conduct a proper investigation,โ€ says Lynn Michaud, Senior Inspector, Ontario SPCA.

โ€œWe have conducted a thorough and exhaustive investigation and, based on the evidence collected, the Society proceeded with charges against the accused. Providing humane and responsible care for your animals is the law. Failing to do so will result in legal consequences.โ€

  1. This is disgusting!! Besides jail time his sentence should also be to get treated in exactly the same way he treated those animals!! Animal cruelty infuriates me!!
